These terms are between you and IPORA LLC ("we", "us"), the publisher of this site. By using the site you accept them. If you do not agree, stop using the site.

The content

This site is a reference. It reports what makers, and the other sources it names, publish about children's play equipment. It is provided for informational purposes only. It is not professional or safety advice and does not replace the maker's manual, the guidance of the U.S. Consumer Product Safety Commission or your own judgement.

Assembly, installation and supervision are yours

Play equipment can cause serious harm when it is assembled, installed, surfaced, maintained or used incorrectly, or used by a child outside the maker's ratings. How to assemble, anchor, surface, inspect and supervise a product is set by its maker's manual. Where we quote a maker's age range, limit or requirement, or a figure published by the Consumer Product Safety Commission, we are reporting it, not certifying it for your yard or your child. Read and follow the manual and check the product against current recall notices before and after you buy.

Calculators and planning aids

The site's calculators do arithmetic on figures published by makers and by the Consumer Product Safety Commission. Their results are estimates for informational purposes only. They do not account for your ground, your yard, your children or the condition of any product, and they are not a statement that any arrangement is adequate.

We do not warrant that any calculator's result is accurate, complete or current. A maker may revise a figure a calculator uses, and an error in a figure or in the arithmetic is possible. Check every result against the maker's manual and current specifications before you buy, build or install.

Recall status

A product page reports what we found in the Consumer Product Safety Commission's recall database on the date shown. Recalls can be issued at any time after that date. A page that shows no recall notice is not a statement that none exists.

No testing claims

We have not tested the products on this site. Nothing here says or implies that we did, and nothing here scores or ranks them.

Figures can change

Makers revise their products. Each product page dates its specification table, its recall check and, where it shows one, its own price; comparisons and calculators are not dated figure by figure. Check the maker's current page before you buy.

Links to other sites, and anything you buy there

We do not sell anything. A purchase through a retailer or maker link is a contract between you and that seller; we are not a party to it. We are not responsible for a seller's products, stock, prices, delivery, returns, warranty or service. The seller's terms and privacy policy apply.

Paid links

Maker and product names belong to their owners and are used here to identify the products discussed. No affiliation, sponsorship or endorsement by a maker is claimed or implied.

Our writing, and what you may do with it

We claim rights in our original text, structure and design, not in the underlying facts. You may read and print our content, quote a passage with a link back, and share links to our pages. Automated agents, including search engines and AI systems, may read, index, cite and summarise our pages and use them to train AI models, as far as /robots.txt and /ai.txt on this domain allow; /llms-full.txt is published for that use. You may not republish our pages or substantial parts of them, or use our content to build a competing reference.

Using the site

Do not damage or overload the site, attempt unauthorised access to it, or use it unlawfully.

No warranties

The site is provided as is and as available. We make no express or implied warranty, including of merchantability, fitness for a particular purpose or non-infringement, and do not warrant that content is accurate, complete or current.

Limits on liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, punitive or consequential loss; lost profits, revenue or data; loss arising from buying, assembling, installing, supervising or using a product, or from relying on a calculator or recall check on this site; or loss arising from a transaction with a seller. Where we remain liable, our total liability for all matters connected with this site is limited to one hundred United States dollars (US$100).

Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or any other liability that cannot lawfully be limited. If you deal with us as a consumer, this section does not affect your statutory rights.

Time limit on claims

A claim connected with this site must be brought within one year after it arises, unless applicable law provides a longer period that cannot be shortened by agreement.

Indemnity

You agree to indemnify and hold harmless the publisher, its members, officers and agents against any claim, loss or expense, including reasonable legal fees, arising from your use of this site in breach of these terms or of applicable law.

Third-party rights

No maker, retailer or network is a party to these terms or may enforce them.

Changes, severability and waiver

We may change these terms and will update the date at the top when we do; changes do not apply retrospectively. If a clause is unenforceable the rest continue to apply, and a delay in enforcing a term does not waive it.

Governing law and where disputes are heard

The laws of the State of Utah govern these terms, without regard to its conflict-of-laws rules. Any dispute will be heard in the state and federal courts sitting in Salt Lake County, Utah.

If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law where you live, or of the right to bring proceedings there where the law gives you that right.
